How Much Is My Case Worth?
You’re not alone in asking this question. This is the single question every client has for me. The answer is the value of your case depends on multiple factors including the severity of your injuries, the extent and length of your treatment, the cost of any future care, any wage loss, and whether you have any temporary or permanent disabilities.
All value drivers must be evaluated, especially the ones insurance companies tend to discount. We help you get your damages documented and established so you can be fairly compensated for the losses you have sustained.
What I can say we do that most other law firms don’t do, we never take more money than you do. If at the end of the day after attorney’s fees and expenses you are walking away with less, we reduce our fee so that you put more money in your pocket. In addition, personal injury awards are generally not subject to taxation, so the amount due to you is tax free.
I can tell you, determining the value of each case is highly specific and in addition to the above factors other considerations are also given to the solvency of the defendant, potential available insurance coverage and liability. How Much Do You Charge?
There are no upfront fees. If I take your case, I advance all costs necessary to move it forward. You pay nothing unless we win.
I handle personal injury cases on a contingency fee basis. My fee is typically 33⅓% if the case resolves before suit is filed, and 40% if litigation becomes necessary. This is the standard contingency fee structure for personal injury attorneys in Louisiana — and many charge more.
Importantly, I make this promise to every client: I will never take home more than you do. That is a guarantee most attorneys do not make. I stand behind it because when someone is injured and their life is changed, they — not their lawyer — should walk away with the larger share.
If your case involves an auto or trucking accident, I will also assist you with your property damage claim and any diminished value claim at no additional charge. I do not take a fee on property damage because I understand how critical reliable transportation is. My goal is to get you back on the road quickly and in a vehicle you feel good about.
In short: there is no risk to you. If we are successful, my fee and costs come from the recovery — not out of your pocket. There is no fee unless we win and there is more for you when we do. If we’re successful, you always walk away with more.
How Long Will My Case Take?
This is the second most frequent question I get asked. The answer is no case is the same. Some resolve in weeks, some in months, but the majority of my cases are more complex and deal with serious injuries and those cases can take longer because documenting outcomes and future care properly takes time.
What I can say definitively, is that I will talk to you about the timeline of your case and keep you updated every step of the way so that we are in it together and so you do not feel alone.
Do I Have to Talk to the Insurance Company?
No. Once you hire Salter Law, we take over all communications with the insurance companies and insurance company adjusters so that you can focus on your treatment and your life. Being put on hold, being transferred and having your claim reassigned to multiple different people is a real headache and is time consuming.
Speaking with insurance companies without an attorney can also be detrimental to your claim. Once you hire us, we handle all communications moving forward so you can avoid the stress of communicating with people who don’t have your best interests in mind.
